Berla Corporation (“us”, “we”, or “our”) collects certain Personal Information (as defined below) in connection with your use of this website and use or purchase our products and services (collectively, the “Services”).
This privacy policy (“Privacy Policy”) informs you of our policies regarding the collection, use and disclosure of Personal Information when you use the Services.
We will not use or share your information with anyone except as described in this Privacy Policy.
We use your Personal Information for providing and improving the Services. By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Berla Website – General Terms of Use Agreement.
Information Collection and Use
While using the Services, you may voluntarily provide (such as when you register for use of our products, contact us with inquiries, respond to a survey or browse or use certain parts of the Services) or we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, other information that can be associated with or which relates to a person and/or could be used to identify a person (“Personal Information”).
To make a payment to us, we require you to provide your billing details, such as a name, address, email address and financial information corresponding method of payment (e.g., a credit card number and expiration date or a bank account number). If you provide a billing address, we will regard that as the location of the account holder.
We also automatically collect certain technical data that is sent to us from the computer, mobile device and/or browser through which you access the Services, such as a unique identifier associated with your access device and/or browser (including, for example, your Internet Protocol (IP) address) characteristics about your access device and/or browser, statistics on your activities on the Services, information about how you came to the Services and data collected through Cookies, Pixel Tags, Local Shared Objects, Web Storage and other similar technologies. We collect this information for the purpose of providing the Service, identifying and communicating with you, verifying your identity, responding to your requests/inquiries, billing and payment on your account, servicing your purchase orders, avoiding fraud or protecting the integrity of our services, and improving our services.
If you provide Personal Information for a certain purpose, we may use the Personal Information in connection with the purpose for which it was provided. For instance, if you contact us by e-mail, we will use the Personal Information you provide to answer your question or resolve your problem and will respond to the email address from which the contact originated. Or, if you supply Personal Information relating to your identity or qualifications to use certain portions of the Services, we will use that information to make a decision as to granting you access to use such Services and to monitor your ongoing qualification to use such Services.
For billing information, we use this information to bill you for products, materials, or subscriptions or other charges and we will disclose this information to our payment processors who help us to process credit card transactions and service providers in connection with billing and collecting amounts owed to us. By using our Services, you authorize us to sub-contract in this manner on your behalf. If your details (as the account holder) are different to the billing contact listed for your account, we may disclose your identity and account details to the billing contact upon their request (such as an account administrator under an enterprise account). By using our Services and agreeing to this Privacy Policy, you consent to this disclosure.
We may use your Personal Information for internal business purposes, including without limitation, to help us improve the content and functionality of the Services, to better understand our Users, to improve the Services, to protect against, identify or address wrongdoing, to enforce our terms of use and agreements with you, to manage your account and provide you with customer service, and to generally manage the Services and our business.
When you interact with the Services, we may also collect information that does not relate to a person and/or cannot be used to identify a person, or that we may anonymize so that it cannot be used to identify a person, i.e., “Non-Personal Information”. The limitations and requirements in this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Information do not apply to Non-Personal Information.
Log Data
When you access the Service (including via mobile devices, through use of our products or website), we may collect certain information automatically, including, but not limited to, the type of equipment or mobile device you use, your device unique identifier, the IP address of your device, your operating system, the type of Internet browser you use and other statistics (“Log Data”).
In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase the functionality of our Services. These third party service providers have their own privacy policies addressing how they use such information.
Cookies
Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our Services for you.

You will then be removed from the marketing email list — however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
Service Providers
We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used. These companies include our marketing agencies, database service providers, backup and disaster recovery service providers, payment services providers, email service providers and others. When we engage another company to perform such functions, we may provide them with information, including Personal Information, in connection with their performance of such functions.
These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.
Parent Companies, Subsidiaries and Affiliates
We may also share your Personal Information with our parent companies, subsidiaries and/or affiliates for purposes consistent with this Privacy Policy. Our parent companies, subsidiaries and affiliates will be bound to maintain that Personal Information in accordance with this Privacy Policy.
Business Transaction
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Information may be part of the transferred assets. You acknowledge and agree that any successor to or acquirer of us (or our assets) will continue to have the right to use your Personal Information and other information in accordance with the terms of this Privacy Policy.
Security; Storage
The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.
We may store Personal Information itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy.
However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure or error free and we are unable to guarantee the absolute security of the Personal Information we have collected from you. Retention
We generally discard information about you when we no longer need the information for the purposes for which we collect and use it–which are described in the section above on “Information Collection and Use”–and we are not legally required to continue to keep it. Notwithstanding, we may retain your Personal Information as part of providing ongoing services for our clients and maintaining updated records as part of our services. When we delete your Personal Information it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons (see “Legal Requirements” section, below) or for legitimate and lawful business purposes.
Legal Requirements
We may disclose your Personal Information if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.
Links To Other Sites
Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Children’s Privacy
Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 16 (“Children”).
We do not knowingly collect personally identifiable information from Children. We encourage parents and legal guardians to monitor their Children’s Internet usage and to help enforce our Privacy Policy by instructing their Children never to provide Personal Information through the Services without their permission. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a Child without verification of parental consent, we take steps to remove that information from our servers.
Exclusions
This Privacy Policy does not apply to any Personal Information that you provide to another User, that another may provide to you, or that may be provided or supplied between Users through the Services or through any other means.
This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by us (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
In an ongoing effort to better understand and serve the users of the Services, we may conduct research on our customer demographics, interests and behavior based on Personal Information and other information that we have collected. This research may be compiled and analyzed on an aggregate basis and this aggregate information does not identify you personally and we therefore consider and treat this data as Non-Personal Information.
International Privacy Laws
If you are using or visiting the Services from outside the United States, including those that fall under the scope of the European General Data Protection Regulation (“GDPR”), please be aware that you are sending information (including Personal Information) to the United States where our servers are located.

EU individuals also have the right to make a complaint to a government supervisory authority.
The information about you that we process when you use the Services in the EU may be used, stored, and/or accessed by individuals operating outside the European Economic Area (EEA) who work for us, other members of our group of companies, or third party data processors. This is required for the purposes listed in the “Information Collection and Use” and “Service Providers” sections above. When providing information about you to entities outside the EEA, we will take appropriate measures to ensure that the recipient protects your Personal Information adequately in accordance with this Privacy Policy as required by applicable law. These measures include:
- In the case of US based entities, entering into European Commission approved standard contractual arrangements with them, or ensuring they have signed up to the EU-US Privacy Shield; or

Certain Rights for California Residents

- Right to Delete: You have the right to request the deletion of your Personal Information that is collected or maintained by us. If we receive and confirm your verifiable consumer request, we shall delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies or as otherwise required by law.
- Right to Non-Discrimination: You have the right not to receive discriminatory treatment by us for the exercise of the privacy rights described above.
- Right to opt-out of the sale of Personal Information: You have the right to request to be opted out from the sale of your Personal Information, if applicable. However, we use and share Personal Information as set forth herein and do not sell Personal Information.

The above rights are subject to our being able to reasonably verify your identity and authority to make these requests. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
The above rights are also subject to various exclusions and exceptions under the law. Under certain circumstances, we may be unable to implement your request, pursuant to applicable law. We will advise you of any reason for denying or restricting a request to the extent permitted by law.
Changes To This Privacy Policy
This Privacy Policy is effective as of the date stated above and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
