The undersigned, on behalf of himself/herself and on behalf of the person or entity for whom he/she is attending training (the “Sponsor”) with Berla Corporation (“Berla”), hereby attests and agrees to the following:

1. The undersigned has requested training on a technique for extracting data from computer chips removed from a printed circuit board (“PCB”), generally referred to as the “Chip-Off” procedure.
2. The undersigned acknowledges, confirms and agrees that use of the “Chip-Off” procedure (as with any technique that involves extraction, handling, or alteration of a computer chip) comes with inherent risks that may result in irreparable total or partial damage to the computer chip including, without limitation, the partial or complete loss of all data contained or stored on the computer chip (collectively, “Damage”). In addition, the vehicle’s entire electronic control unit is rendered unusable once the computer chip is removed and a new complete replacement unit should be purchased and used if the device or vehicle needs to operate with one in good working order.
3. Damage may occur from a number of causes including, without limitation, (i) resulting exposure to high levels of heat at the temperatures provided for the relevant chip in the training, with too little heat or too much heat potentially resulting in permanent Damage, (ii) Damage resulting from spilt liquids, improper electric power application, or physical damage occurring during the procedure, and (iii) other risks discussed in the training session or described in Berla’s relevant training manuals. While Berla will attempt to outline these risks in the training, there is no assurance that the training will include all risks, whether known or unknown, and it is expressly understood and agreed that the Chip-Off procedure, during and after the Berla training course, itself comes with an inherent risk of Damage and is undertaken entirely at the undersigned, and the Sponsor’s sole risk.
4. The Chip-Off procedure also involves the use of hot air guns and soldering irons, and ‘Wet’ evidence (blood spatter or other bodily organic material) may be encountered in the field; proper personal protection equipment (“PPE”) including eye protection is always required. Berla will provide safety equipment such as eye protection, heat glove, and fume extractor, to mitigate these risks for the training course and this equipment is strongly recommended to be acquired for future Chip-Off procedures. Despite the measures taken to prevent injury, the undersigned acknowledges the Chip-Off procedure involves use of equipment that generates high-levels of heat, potentially leading to situations where injury may occur. The undersigned agrees to follow directions from instructors during the training course and will wear provided PPE.
5. The undersigned assumes any and all risks associated with use of the Chip-Off procedure including, without limitation, those described above, and on behalf of himself/herself and the Sponsor, to the fullest extent permitted by law, hereby waives, releases, and forever discharges Berla, its affiliates, and their respective officers, directors, employees, shareholders, vendors, agents, representatives and insurers (collectively, the “Released Parties”), from any and all claims, causes of action, damages, injury, liability, and loss of any kind or nature arising from or relating in any way to any use of the Chip-Off procedure during and after the Berla training course. This includes, without limitation, any claim arising from the negligence of the Released Parties.
